Had an inquiry today that I thought merited tapping the collective wisdom of the List. A small company has been selling drinking glasses, beer mugs and such printed with original artwork. After about a year of doing this (I'll hazard a blind guess and say a couple thousand glasses), the manufacturer of the ink they are using said "oh, by the way, our stuff should have California Prop 65 warnings on them." No idea what the basis for that is or what kind of levels we might be talking about, but I think we can all take a couple guesses. They sell to various retailers and on their web site, but have no CA nexus (they are located on the East Coast).
Obviously, this is a lesson everyone should have figured out in the 1970's with Ronald McDonald's lead paint fiasco-.although they had to learn it all over again in 2010. I bet Monona has a file cabinet full of stuff on that!
Anyway, I think he's looking to get some bearing for what to do next as they've been blindsided on this. If anyone has experience in this area and wants to follow up with him, please contact me OFF LIST. Alternatively, if anyone knows where he might turn for some legal advice on this, that would be welcome, too. He genuinely wants to do the Right Thing without being taken to the cleaners, of course.
I will suggest that they start by testing the glasses to see what they're actually facing.
